Terms of Service

1. Acceptance of Terms

By accessing or using the QurbanOps platform (“Platform”, “Service”), operated by Smart Hub LLC, a New Mexico limited liability company (“Company”, “we”, “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Platform. These Terms apply to all users, including organization administrators, operators, and any other individuals who access the Platform.

2. Service Description

QurbanOps is a Software-as-a-Service (SaaS) platform that enables charitable organizations to:

• Record and manage video documentation of qurban (animal sacrifice) processes.
• Automatically notify donors with their personalized video via WhatsApp and SMS.
• Manage donor data, animal records, and operator assignments through a web-based dashboard.
• Generate QR-coded cards, import data from spreadsheets, and track operations in real time.

The Platform operates as a Progressive Web App (PWA) with offline support for field operators.

3. User Accounts

To use the Platform, your organization must create an account. You are responsible for:

• Providing accurate and complete registration information.
• Maintaining the security of your account credentials.
• All activities that occur under your account or through operators you authorize.
• Promptly notifying us of any unauthorized use of your account.

You may not share account credentials or allow multiple individuals to use the same operator account simultaneously. Each operator must have their own authorized account.

4. Acceptable Use

You agree to use the Platform only for its intended purpose and in compliance with all applicable laws. You shall not:

• Use the Platform for any unlawful purpose or in violation of local, national, or international laws.
• Upload content that is defamatory, obscene, threatening, or violates the rights of others.
• Attempt to gain unauthorized access to the Platform, other user accounts, or our infrastructure.
• Reverse engineer, decompile, or disassemble any part of the Platform.
• Use automated systems (bots, scrapers) to access the Platform without our written consent.
• Transmit viruses, malware, or any code designed to disrupt or damage the Platform.
• Share donor personal data or videos outside of the Platform without proper authorization and consent.

5. Data & Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data.

As an organization using QurbanOps, you act as the data controller for donor personal data uploaded to the Platform. You are responsible for ensuring that you have the necessary legal basis (such as consent or legitimate interest) to process donor data through our Platform. QurbanOps acts as a data processor on your behalf.

You agree to comply with all applicable data protection laws, including GDPR and KVKK, when using the Platform to process personal data.

6. Intellectual Property

The Platform, including its design, code, logos, trademarks, and documentation, is the intellectual property of QurbanOps and is protected by copyright and trademark laws.

You retain ownership of all content (videos, donor data, organizational data) that you upload to the Platform. By uploading content, you grant QurbanOps a limited license to store, process, and transmit that content solely for the purpose of providing the Service.

This license terminates when you delete your content or close your account, subject to any applicable data retention requirements.

7. Payment & Billing

QurbanOps offers free and paid subscription plans. Details of pricing, features, and limitations for each plan are available on our pricing page.

• The Free plan includes 100 notifications at no cost.
• Paid plans are billed monthly. You will be charged at the beginning of each billing cycle.
• All fees are exclusive of applicable taxes, which will be added where required.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We reserve the right to change pricing with 30 days advance notice.

8. Service Availability & Disclaimer

The Platform is provided “as is” and “as available.” While we strive to maintain high availability, we do not guarantee uninterrupted or error-free operation.

To the maximum extent permitted by law, QurbanOps disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

The offline functionality of the Platform depends on device capabilities and browser support. We do not guarantee offline functionality on all devices.

9. Limitation of Liability

To the maximum extent permitted by applicable law, QurbanOps shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of data, revenue, profits, or business opportunities.
• Delays or failures in notification delivery caused by third-party services (WhatsApp, SMS providers, internet connectivity).
• Any loss resulting from unauthorized access to your account due to your failure to maintain credential security.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to QurbanOps in the twelve (12) months preceding the claim.

10. Termination

You may terminate your account at any time by contacting us or through the account settings in the dashboard.

We may suspend or terminate your access to the Platform if:

• You violate these Terms or any applicable law.
• Your use of the Platform poses a security risk or may adversely affect other users.
• Your account has been inactive for more than 12 consecutive months.
• Required by law or a valid legal order.

Upon termination, your right to use the Platform ceases immediately. We will retain your data for a reasonable period to allow data export, after which it will be deleted in accordance with our Privacy Policy.

11. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via the Platform or email at least 30 days before they take effect. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

If you do not agree with the updated Terms, you must stop using the Platform and may request account deletion.

12. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. For users in the European Union, mandatory consumer protection laws of your country of residence shall apply where required.

Any disputes arising from or relating to these Terms or the Platform shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to the competent courts of Istanbul, Turkey.
